Terms Of Use

Use of camuni.co.uk

Camuni.co.uk is operated and maintained by Indigo Clothing Ltd. Unless otherwise stated, all products and services made available through camuni.co.uk are provided by Indigo Clothing Ltd. Registration may not be required, but by placing an order you agree to be bound by these Terms and Conditions. Specific services made available through the camuni.co.uk may be subject to additional terms and conditions, which will apply concurrently to these Terms and Conditions.

Amendments

Indigo Clothing Ltd may update these Terms and Conditions from time to time and any changes will be notified to you via the e-mail address provided by you when you placed your order or via a suitable announcement on camuni.co.uk. The changes will apply to the use of camuni.co.uk after Indigo Clothing Ltd has given notice. If you do not wish to accept the new Terms and Conditions you should not continue to use camuni.co.uk. If you continue to use camuni.co.uk after the date on which the change comes into effect, your use of camuni.co.uk indicates your agreement to be bound by the new Terms and Conditions.

Prices

The prices and delivery charges payable for the products or services that you order are clearly set out on camuni.co.uk. If, by mistake, an item is under-priced, Indigo Clothing Ltd will not be liable to supply that item to you at the stated price, provided that Indigo Clothing Ltd notifies you before the item is dispatched. All prices are expressed exclusive of any VAT payable unless otherwise stated.

Acceptance

There will be no contract of any kind between you and Indigo Clothing Ltd unless and until Indigo Clothing Ltd actually dispatches the goods to you. Your order is an offer to buy from Indigo Clothing Ltd. Nothing that Indigo Clothing Ltd does or says will amount to any acceptance of that offer until Indigo Clothing Ltd dispatches the goods to you. At any point up until then, Indigo Clothing Ltd may decline to supply the goods to you without giving any reason. At the moment that the goods are dispatched (and not before), a contract will be made between you and Indigo Clothing Ltd, and you will be charged for the goods.

Delivery

Delivery will be made to the address specified by you on the completed order form. Indigo Clothing Ltd will aim to deliver goods as stated but cannot guarantee delivery by such a date, however all orders will be delivered within 28 days.

Cancellation

If you order goods, you have the right to cancel your order up to 7 working days after the day following the delivery of the goods. In the event that the goods have already been dispatched at the date of receipt of your cancellation of the order you must return the goods and Indigo Clothing Ltd will credit your credit or debit card with the price of the goods within 30 days beginning with the day on which notice of cancellation was given. If you do not return the goods within 21 days of your cancellation, Indigo Clothing Ltd will make a charge in respect of the cost of recovering the goods. If you do not return the goods or fail to make them available for collection within 30 days of your notice of cancellation, you will be deemed to have accepted the goods, at which point a new purchase contract will be made and you will be charged for your order at the price set out on camuni.co.uk. If your order is for the provision of services, please note that you will be unable to cancel the contract once performance of the services has begun. This does not affect your statutory rights.

Returns

You can return any purchase for goods within 30 days of the date the goods are received for any reason, on the sole condition that any item is returned to Indigo Clothing Ltd in its original condition. Indigo Clothing Ltd will issue a full refund for the price that was paid for the item. You have the right to return a faulty item within a reasonable period of time, but please keep any warranty information that accompanies the item as this will be needed should there be a fault. If you take delivery of a purchase from Indigo Clothing Ltd and the contents have been damaged in transit, you may return the item(s) to Indigo Clothing Ltd within 30 days of receipt for an exchange. If you return an item because of an error on Indigo Clothing Ltd's part or because it is defective, Indigo Clothing Ltd will be happy to refund the delivery charges incurred in sending the item to you and the costs of returning it to Indigo Clothing Ltd. If cancelling the purchase under the statutory 7 working days cooling-off period, Indigo Clothing Ltd will refund the normal postage charge for the delivery of that item but cannot refund any express or courier postage charge. You will be responsible for those charges and the costs of any other services provided in connection with your purchase. Any customer wanting to make a return or cancellation needs to contact us.

Intellectual property

The content of camuni.co.uk is protected by copyright, trade marks, database and other intellectual property rights. You may retrieve and display the content of camuni.co.uk on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on camuni.co.uk. No licence is granted to you in these Terms and Conditions to use any trade mark of Indigo Clothing Ltd, University of Cambridge or their affiliated companies including, without limitation, the trade marks University of Cambridge, CAMUNI and Indigo Clothing.

Availability of camuni.co.uk

Although Indigo Clothing Ltd aims to offer you the best service possible, Indigo Clothing Ltd makes no promise that camuni.co.uk will be fault free and available at all times. If a fault occurs in the service you should report it to Customer Services (see above for contact details) and Indigo Clothing Ltd will attempt to correct the fault as soon as reasonably possible. Your access to camuni.co.uk may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. Camuni.co.uk will attempt to restore the service as soon as it reasonably can.

Liability

Due to the standardised nature of the products and services made available through camuni.co.uk, Indigo Clothing Ltd cannot guarantee that such products and services will meet your precise needs or circumstances. You must also bear the risks associated with the use of the Internet. Indigo Clothing Ltd disclaims all liabilities in connection with the following:

  • incompatibility of camuni.co.uk with any of your equipment, software or telecommunications links

  • advice and materials provided by third parties or through external web sites

  • advice and opinions expressed in the FAQs or Articles of camuni.co.uk

  • the suitability of the content, usability and impact on your systems of any product downloaded from camuni.co.uk

You agree that Indigo Clothing Ltd will not be liable to you or any third party for any consequential or incidental loss or damage (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other direct, indirect, special or punitive damages whatsoever that arise out of or are related to the use of camuni.co.uk. Nothing in these Terms and Conditions shall exclude Indigo Clothing Ltd's liability for personal injury or death caused by its negligent act or omission or wilful misconduct or any other liability which cannot by law be excluded or restricted.

Data protection

All personal information collected via camuni.co.uk will be used in accordance with the Privacy Policy.

Law and jurisdiction

These Terms and Conditions will be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.

General

You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. If you breach these Terms and Conditions and Indigo Clothing Ltd ignores this, Indigo Clothing Ltd will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions. Indigo Clothing Ltd shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control. Indigo Clothing Ltd shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control. A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this will not affect any right or remedy of a third party which exists or is available apart from that Act.
